Family of Nancy Benoit back in court today over Hustler photos

The 11th Circuit Court of Appeals herd arguments today in the case involving Hustler's publishing nude photos of the late Nancy Benoit after she was murdered by her husband, Chris. The case was decided in June 2011 with Nancy's family receiving a $19.6 million award that was later reduced to $250,000 due to a Georgia law capping damages. Nancy's family was there to argue that the damages should be reinstated to the original amount, while Hustler argued that their publishing of the photos was their First Amendment right. Shore's Slant: It is interesting to note that the 11th Circuit is the court that ruled a notorious death does not allow publishers the right to publish any images they wish. This is going to be big news no matter which way it goes, either because of the fine or because of the First Amendment implications.
