Appeals court overturns Nancy Benoit award

The 11th U.S. Circuit Court of Appeals on Tuesday overturned the award a jury gave the estate of Nancy Benoit over nude pictures published by porn magazine Hustler, citing a lack of evidence to support the award. Shore's Slant: The story doesn't say, but I would assume this was a three judge panel. Should Nancy's estate (read: her parents) decide to appeal further, they could do so to the full appeals court (assuming again this was a panel and not the full court) and the Supreme Court. My guess is also that the Supreme Court would not hear the case, so options are running out for Nancy's family.
